Terms & Conditions

HOTEL RULES & MANAGEMENT POLICIES

To ensure a pleasant stay, Hotel Management kindly requests your cooperation in observing the following terms and conditions, which serve as an agreement between you and CHAN LIVING for use of our guest rooms:

TARIFF
The room rate includes lodging and breakfast for 2 guests. Please note that additional meals, amenities, and services are available at an extra cost. If you wish to upgrade your room amenities or services, kindly contact the Front Desk.

TOURISM TAX
In accordance with the Malaysia Tourism Tax Act 2017, and with effect from 1st May 2019, registered tourists are subject to an additional MYR 10.00 flat rate per room, per night. This will be reflected in your guestroom’s folio and collected as a separate amount (in addition to quoted room charges) upon your departure. Please note that MyKad (Malaysian) and MyPR (Permanent Resident of Malaysia) are exempted from this tax.

RESERVATIONS
All bookings are subject to availability. Once your booking has been confirmed, a reference number will be issued, which you should present upon check-in along with proof of identity (NRIC/Passport). The person named in the booking must be the same as the person who will be staying. If this is not the case, CHAN LIVING reserves the right to cancel the room or request the named person be present during check-in. Please inform us if you are booking on behalf of others.
Your room will be held until 2300 hours on the day of your scheduled check-in, after which the booking will be deemed cancelled unless we are informed otherwise.

TENTATIVE RESERVATIONS
The hotel holds the room(s) for the guest(s)/agent(s) till a 7-day cut-off date, by which the guest should confirm the reservation. Upon confirmation from the guest, the hotel changes the tentative reservation to a confirmed reservation, and updates its records accordingly. If the confirmation is not received from the prospective guest by cut-off date, the reservation is cancelled and the rooms’ inventory is updated. A 50% deposit is required to secure the booking. The balance or full payment must be settled at least 7 days prior to the arrival date.

CANCELLATION
Once bookings made and/or guest(s) checked in, bookings are non-refundable. Chan Living is not responsible for personal emergencies, weather, or schedule changes. Any cancellations not caused by the hotel will result in forfeited monies. However, guests can amend their date without incurring a cancellation fee, provided the amendment is made at least 7 days prior to the scheduled check-in date. For guests who book through a third-party platform, kindly refer to the cancellation policy shown on their booking information.

CHECK-IN
Our check-in time is from 14:00 to 23:00 hours. If you will be arriving later than 23:00, please inform us in advance so we can make arrangements for your check-in. Upon arrival, all guests are required to fill out and sign a registration form. Please have your ID card or passport ready for presentation upon check-in, as we are required by law to keep records of personal documents. Early check-in may be available upon request and subject to availability.

CHECK-OUT
We kindly ask our guests to check out before 11:00. If you need to extend your stay, you may request a 2-hour extension depending on room availability. Please note that failure to vacate your room on time may result in additional charges. Late check-out between 2 and 5 hours will be charged 50% of the room rate per night. Any check-out later than 5 hours will be charged at the full room rate per night.

PERSONAL DATA USE
We take the privacy and security of our guests' personal information seriously. By checking in, you consent to Chan Living processing (photocopying/scanning) your personal documents for registration purposes only. Rest assured that all personal data will be handled in accordance with our privacy policy.

OCCUPANCY
Our room can accommodate a maximum of three (3) guests. An additional guest will be charged RM50 per night per room, and an extra bed and breakfast will be provided.
The total number of occupants in a room, including children, shall not exceed the maximum number of occupants permitted for the room.

CHILD POLICY
A maximum of two children under the age of 12 years old are allowed to share the room without additional charges.

PAYMENT
Payment for the full amount of the stay is required upon check-in. We accept cash, e-wallet, bank transfer and credit cards.

SWIMMING POOL
We have two outdoor swimming pools with depths of 2.5 feet and 4 feet for children and adults, respectively. Please be advised that there is NO LIFEGUARD ON DUTY, DO SWIM AT YOUR OWN RISK. A minimum of two swimmers should be present when using the pool. Night swimming is not encouraged due to insufficient lighting.
Our pool is exclusively for our guests. Visitors are NOT ALLOWED TO USE THE SWIMMING POOL unless they pay RM50 per person. All pool users are strongly advised to leave the pool immediately during thunderstorms, lightning, or any other life-threatening or emergency situation, as directed by authorised Management personnel.
Street shoes are not allowed on the decks. All pool users must wear appropriate swimming attire such as swimsuits or swimming trunks. Cut-offs, gym shorts, underwear, and other inappropriate clothing are strictly prohibited. Clean swim shirts (non-cotton) may be worn for modesty or medical reasons.
Children under 16 must be accompanied and actively supervised by a responsible adult aged 18 or older. Children aged five and under must have an adult in the water with them at all times. Running, jumping, pushing, horseplay, dunking, dumping, throwing, and any form of “rough play” are strictly prohibited in the pool area. No food or drinks are allowed in the swimming area or its surroundings (decks). DIVING AND JUMPING INTO THE POOL ARE PROHIBITED.
Individuals with skin diseases, sore or inflamed eyes, colds, nasal or ear discharge, communicable diseases, or wearing bandages or band-aids are not permitted to use the pool. Persons with exposed sub-skin, tissues, open blisters, cuts, etc., are warned that these are likely to become infected and are prohibited from using the pool. Anyone experiencing even a mild case of diarrhea may not use the pool. Anyone not toilet-trained (incontinent) who wishes to enter any pool must wear a clean disposable swim pant covered by separate rubber/vinyl pants, both of which must fit snugly around the legs and waist. Disposable diapers are not allowed. If the swim pants become soiled, the person must leave the pool immediately, take a soap shower, and replace the swim pants with clean rubber/vinyl pants before returning. Please change all diapers off the deck for health reasons.
Chan Living retains the right to suspend or expel swimming pool users for failure to comply with the pool rules. Chan Living, to the extent permitted by law, shall not be liable or responsible for any loss of life or injury sustained by any person using the Pool Amenities.
Guests should recognise and acknowledge the inherent risks and dangers of physical injury while swimming and using the Pool Amenities. By using the Pool Amenities, guests voluntarily assume the full risk of any and all injuries, damages, or loss that guests, family members, or friends may sustain. Guests also agree to waive and relinquish all claims against Chan Living that they, their family members, or friends may have as a result of using the Pool Amenities.

FREE WIFI ACCESS
Complimentary WiFi is available to all registered guests. Please note that the hotel's WiFi access code is subject to change without prior notice. Signal strength may vary depending on the location of the room, equipment status, and potential interference from other wireless signals in the area. Chan Living is not liable for any guest use of the WiFi.

WATER CUT & POWER CUT
No payment will be refunded if there is a power cut or water supply cut happened during stay.

LUGGAGE STORAGE
Guests may store their luggage in our storage space subject to availability. However, guests are responsible for any loss or damage to their belongings. Luggage may not be stored for more than three days, and extended storage is available for an additional fee. Please inquire at the front desk for availability and tariffs.

SMOKING
For the comfort and safety of all guests, smoking is strictly prohibited in guest rooms and the swimming pool area. A penalty fee of RM300 will be charged to any guest found smoking in the room, and RM500 for smoking in the swimming pool area.

ITEMS THAT ARE PROHIBITED TO BRING IN TO THE ROOMS
To ensure the safety and comfort of all guests, the following items are strictly prohibited in Chan Living rooms:
1) NO Strongly scented/staining food items (e.g., durians, mangosteens)
2) NO Pets (except for service animals and livestock)
3) NO Non-prescribed drugs, flammable liquids, biohazards, and heavy machinery
4) NO Electronic/electrical appliances that may interfere or obstruct with the hotel's computer network/systems
5) NO Any other items that may disrupt hotel operations or other guests' stays.

ROOM KEYCARDS
Room keycards will only be issued to registered guests. Youth under the age of 18 will not be issued keycards. If a guest loses their keycard and requires a replacement, a valid government-issued photo ID (passport or IC) is required. All keycards must be returned to the front desk upon check-out; failure to do so will result in a penalty of MYR50.00 per unreturned keycard.

GUEST'S BELONGINGS
Guests are responsible for securing their rooms by locking the doors when leaving or sleeping. Chan Living is not responsible for any loss or damage to guests' belongings from the Hotel room or any other part of the Hotel for any cause whatsoever, including theft.

VISITORS
Guests may have not visitors in their rooms or our property. A supplement fee of RM50 per person per night applies for additional guests or visitors. Additional RM50 per person applies to any visitor who used the pool.

AIRPORT SHUTTLE
Please contact the Front desk to arrange for airport shuttle service or pick-up.

HAZARDOUS GOODS
For the safety of all guests, the possession of weapons, explosives, inflammable objects, hazardous materials, or dangerous chemicals on hotel premises is strictly prohibited. The Guest shall be solely liable and responsible to Chan Living, other guests, invitees, visitors, and personnel for all loss financial or otherwise and damage that may be caused by such articles or as a result of the Guest’s own negligence and non-observance of such rules and instructions.

ALCOHOL & DRUGS
Consumption of alcoholic beverages in or on the premises is limited to persons of legal age. Guest(s) understands that there is to be no excessive drinking of alcohol. Illegal drug use is strictly prohibited. Guest(s) in violation of this policy will be required to vacate the premises without refund.

DAMAGES
Guests will be charged accordingly for any damaged or lost item in the room.

PARKING AT OWN RISK
All vehicles parked on hotel premises are at the owner's risk. Chan Living is not liable for any damage, theft, or loss of any vehicle, occupants, or contents while operated or parked near the hotel property.

NOISE
Guests are asked to keep noise levels to a minimum between 10:00 PM and 8:00 AM to respect the comfort of other guests. Televisions, voices or other devices must be kept at a respectful low level at all times. Doors should be opened and closed quietly, and congregating or running in halls is prohibited.
If you become aware of a disruptive guest, please contact Front Desk staff immediately by phone or in person.

NO PARTIES:
Chan Living enforces a No In-Room Party Policy to ensure we can protect the hotel and our guests at all times. No parties, loud disturbances, and/or noise nuisances are allowed or tolerated on these premises. In the event of a disturbance, one polite request (warning) will be given to reduce the noise. If our request is not followed, the guest will be asked to leave the hotel without a refund. Registered guest(s) are responsible for all persons visiting. Non-Registered visitors are only permitted until 11:00 PM. If found with more “people” not listed on the Guest Registration Form after 11:00 PM, your stay will be considered a party. You will be ordered to vacate the premises without a refund and may be assessed a Guest Compensation Disturbance Fee.

COOKING, COOKING APPLIANCES, COMBUSTIBLES, OR FIREWORKS:
The preparation of food in guest rooms by any type of cooking appliance is prohibited. A minimum fee of MYR 500.00 will be charged for cooking in a room, including, but not limited to, coffee makers, hot plates, toaster ovens, water heaters, rice cookers, combustibles, open flame, barbecue grills, burners, heating appliances, or any other item intended for cooking. Open fires, flames or cooking grills, either charcoal or gas, and fireworks are not allowed anywhere on the hotel property.

DAMAGE TO PROPERTY
Guests will be held responsible for any loss or damage to Chan Living property caused by themselves, their guests or any person for whom they are responsible. In case of damage caused to the Hotel by the Guest, the Guest is due to cover the cost of all damage caused to the Hotel.

GUEST COMPLAINTS
Guests shall address all their complaints at the Front desk.

RIGHT TO REFUSE SERVICE
Chan Living is privately owned and operated. We reserve the right to refuse service to anyone for any reason(s) that does not violate Federal or State laws. Chan Living has a zero-tolerance policy in which we will refuse to admit or refuse service or accommodation in our hotel or may remove a person, without refund, who refuses to abide by the reasonable standards and policies established by Malaysian Law and the owners for the operation and management of the hotel. Chan Living will refuse service or evict a guest: for refusal or failure to pay for accommodations; is under the influence of alcohol, drugs, or any other intoxicating substance and acts in a disorderly fashion as to disturb the peace of other guests or is not in compliance with state liquor laws; acts in a disorderly fashion as to disturb the peace of other guests; is unable to properly supervise their children at all times; seeks to use the hotel for an unlawful purpose; seeks to bring into the hotel: an unlawfully possessed firearm; or something, including an explosive or hazardous or toxic substance, that is unlawful to possess and that may be dangerous to other persons; destroys, damages, defaces, or threatens harm to hotel property or guests; causes or permits persons to exceed the maximum allowable occupancy of room; refuses to abide by the reasonable standards or policies established by Chan Living for the operation and management of our hotel.

GOVERNMENT RULES AND REGULATIONS AND APPLICATION OF LAWS
Guests are requested to observe, abide by, confirm to and be bound by all applicable acts and laws and Government rules and regulations of Malaysia. The Hotel Management reserves the right to add to, or alter or amend any of the above Terms, Conditions and Rules.

CHANGES OR MODIFICATION TO THE HOTEL POLICY
Chan Living reserves the right to amend, modify, change, cancel, vary or add to these Hotel Policies or the arrangements and content featured on the Hotel website at any time without prior notice. Please check the Hotel website regularly for updates to the Hotel Policy. Any modification to these Hotel Policy that occurs before the guest’s departure is considered a part of the guest’s reservations agreement with us. A copy of these Hotel Policy is located in the hotel room and if there is no copy found, please request at the reception.
