Patonga is a fishing village of only 200 permanent residents located 60 minutes from Hornsby or 30 minutes by ferry or water taxi from Palm Beach. Located on the 1st floor of the The Boathouse Hotel Patonga are three apartments. These are fully self contained apartments with large undercover balconies and views of Patonga Beach.

Schedule A
General
1. Definitions:
a. Accommodation means the room/apartment operated by Patonga Beach Hotel where your stay will occur, as selected by you and listed on the Form.
b. Agreement means these terms and conditions, the Form and the Accommodation Package Information.
c. Customer/You means you, the customer named in the Form.
d. Fees means the total fees payable to us for booking of accommodation as set out in the Accommodation Package Information and otherwise payable in accordance with this Agreement.
e. Force Majeure Event means an act of God, fire, lightning, earthquake, explosions, flood, subsidence, insurrection or civil disorder or military operations or act of terrorism, expropriation, strikes, lock-outs or other industrial disputes of any kind not relating solely to Patonga Beach Hotel, and any other event which is not within the reasonable control of Patonga Beach Hotel.
f. Form means the Booking Form which is part of this Agreement.
g. Peak Periods means periods during which the Accommodation is at peak demand as determined by us, during which Fees may be increased and different cancellation and booking terms may apply, as advised by Patonga Beach Hotel.
h. Security Credit Card means the Customer’s credit card used as security for the booking, the details of which are provided on the Form.
i. Patonga Beach Hotel/Us means BOATHOUSE PATONGA HOTEL PTY LTD ACN 620 302 696.

2. The Accommodation is available for hire subject to the terms of this Agreement.

3. Patonga Beach Hotel reserves the right to refuse any booking without the necessity to give reasons for such refusal to the Customer.

4. No Accommodation may be used for functions, parties or events and all Bookings are for personal use only and are non-transferrable.

5. Reservations
a. Except at the discretion of Patonga Beach Hotel, reservations and tentative bookings do not constitute any commitment by us to accept your Accommodation request.
b. All Bookings must contain the correct number of guests, such number must not exceed the maximum capacity of the Accommodation. We reserve the right to charge additional Fees for guests
c. Please ensure that you advise on the Form as to any children or infants who will be part of your group so that we may arrange roll away beds (subject to availability and Fees).
d. During Peak Periods, we may impose different payment requirements and amounts in respect of Fees/Deposits, different cancellation terms and other terms as advised by us.
e. We reserve the right to impose minimum nights stay requirements at any time.

6. Food/Beverages
a. Except at the discretion of Patonga Beach Hotel, the Customer and their guests are not permitted to bring food or beverages to the Accommodation.

7. Pets
a. Whilst we love furry critters, unfortunately Patonga Beach Hotel does not permit pets to stay or visit in our Accommodation.

8. Incidentals, Damage and Your Security Credit Card
a. On or before you check-in, we will charge a hold the entire amount to your provided card.
b. The Customer is liable for any loss, damage or injury suffered by Patonga Beach Hotel, its employees, contractors and/or agents and any loss or damage caused to the Accommodation, our equipment, furniture, fixtures, fittings, systems, decorations or other property to the extent that such loss, damage or injury is caused or contributed to by the Customer and/or any of its employees, contractors or guests.
c. The Customer indemnifies Patonga Beach Hotel, its employees, contractors and/or
or proceeding arising under any statute or at common law in respect of injury, loss or damage to property, real or personal, including cash, or in respect of personal injury to, or death of, any person arising out of or in connection with their use of the Accommodation and/or any breach of this Agreement by the Customer, its employees, contractors or guests.
d. Without limiting any other provision of this Agreement, the Customer acknowledges and agrees that Patonga Beach Hotel may charge the Security Credit Card for such amount as is required to cover any loss, damage, costs, claims, expenses and liabilities incurred as a result of any action, inaction or any breach of this Agreement on the part of the Customer, its employees, contractors or guests. For the avoidance of doubt, the Customer is liable for the actions of each of its invitees.
e. The Customer is liable for any additional charges (i.e. for additional guests, additional hours/days of stay, laundry, cleaning fees, room service, meals/beverages, treatments, transfers etc) charged to the Customer’s room by the Customer (or the Customer’s guests) or incurred under these Terms. The Customer acknowledges and agrees that Patonga Beach Hotel may charge the Security Credit Card for any such additional charges and incidentals.

10. Car Parking and Your Goods
a. The Venue does not have storage facilities other than the Accommodation booked by the Customer.
b. We cannot guarantee parking, however please advise us if you are driving to Patonga Beach Hotel and we will attempt to assist you.
c. To the extent permitted by law, in particular to the extent permitted by the Inkeepers Act 1968 (NSW), Patonga Beach Hotel will not accept any responsibility for any damage, theft or loss of goods and valuables during your stay. In the event that we cannot exclude liability, such liability is capped at $100.
d. All goods must be removed at the conclusion of your stay. Any goods left without prior arrangement will be deemed abandoned and will be dealt with by us in accordance with the Uncollected Goods Act 1999 (NSW).

11. Directions
a. In the event of an emergency, the Customer and guests will follow the directions our staff to evacuate the Accommodation if instructed to do so.

12. Observance of Laws
a. The Customer and its guests shall in all respects observe and comply with the provisions of all relevant State or Federal legislation.

13. Use of Accommodation
a. The Customer shall conduct and use the Accommodation in a proper, orderly and lawful manner and shall not permit any act, matter or thing which may injure the reputation of Patonga Beach Hotel or cause loss or damage to any person or property and may not disrupt the quiet use and enjoyment of other guests.
b. We reserve the right to terminate your use of the Accommodation if an incident occurs or you, or your guests are in breach of these terms or
c. any law. We reserve the right to remove a person/s without liability if behaviour is not considered appropriate.
d. Patonga Beach Hotel and our staff adhere to Responsible Service of Alcohol as follows:
• Liquor will not be sold or supplied to a person or persons under the age of eighteen years.
• Proof of age must be provided on request
• We will not permit intoxication or any indecent, violent or quarrelsome conduct on the licensed premises.
• Liquor will not be supplied to any person or persons who are at the time in a state of intoxication. Accordingly, patrons will be denied service if they are considered to be intoxicated.
• You must not bring our own Liquor onto the Accommodation.

14. Smoking
a. In the interest of public health, and in line with Government Regulations, the Accommodation is a smoke free venue. No smoking (including e cigarettes) are permitted indoors and guests will be directed to a permitted smoking area.

15. Prohibitions
a. Cleaning fees will apply if your Accommodation is left in an unreasonably unclean state, as determined by us.
b. The use of candles and candelabra are prohibited in our Accommodation.
c. No illegal items, flammable liquids or other dangerous substances shall be brought to the Accommodation.

16. Liability
a. To the extent permitted by law, we do not accept liability to you or your guests for any liabilities, loss, damage or injury arising from or connected to the use by the Customer, its employees, contractors or guests of the Accommodation and/or the consumption of any food or beverages. Use of the Accommodation is at the Customer’s own risk.
b. To the extent permitted by law and subject to paragraph c, our liability in connection with this agreement and the Accommodation (other than liability for guest possessions) is limited to the Fee.
c. Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law.

17. Insurance
a. The Customer must ensure that any personal property that is brought into the Accommodation have been insured by either the Customer or insurer.

18. Force Majeure
a. To the extent permitted by law, if Patonga Beach Hotel is rendered unable wholly or in part by a Force Majeure Event to carry out its obligations then this shall not affect the operation of the terms and conditions of this Agreement, and the risk of frustration is to be borne by the Customer.

19. Personal Information
a. You consent and authorise Patonga Beach Hotel to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.
b. You consent to information which you have provided to us as part of your booking being used by Patonga Beach Hotel or any of their related bodies corporate for the purpose of informing you about offers and promotions which relate to Patonga Beach Hotel and its related bodies corporate.
c. We will not provide or disclose any information you have provided to us to any person other than a related body corporate without your prior written consent.

Payment Policy

Payment of Fees

a. The cost of accommodation must be paid up front or prior to the commencement of your stay by credit card when the booking is placed

b. Payments of $500 or more by credit card will incur a 1.5% surcharge for MasterCard or Visa or 2% for American Express.

c. Failure to remit the specified amount of Fees may result in the booking being cancelled.

d. If your stay is extended with our agreement, we may require you to pre-pay for such additional nights in advance. Where your stay is extended without our prior agreement, the rates applicable to any additional hours/days will be charged on a pro rata basis at a rate equivalent to 2 x the average rate applicable during your stay. We may charge such additional Fees to your Security Credit Card without notice.

Cancellation Policy

a. If the Customer cancels a booking after it has been confirmed, written notification is required. Where the booking is cancelled within 7 days of the commencement of your stay, 50% is paid to The Boathouse Hotel Patonga at the time of cancellation is forfeited.

b. In the event the Customer cancels the booking more than 7 days prior to the commencement of the stay, the full amount will be refunded.

c. Clauses a and b of this Section may not apply in Peak Periods, during which the Hotel will retain all Deposits regardless of time of cancellation and/or may require all Fees to be paid in full
at the time of Booking (such Fees being non-refundable).

Changes to a Booking

a. Except at the discretion of The Hotel, a Customer wishing to transfer a confirmed booking to an alternate date, change the selected Accommodation or select a different package remains liable for all Fees paid and all Fees due.
