BY MAKING A BOOKING FOR A STAY AT REAL COAST & SURF YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS. PLEASE READ THEM CAREFULLY BEFORE YOU PROCEED WITH YOUR BOOKING.

GENERAL

Your contract is with ADELOBRA VENTURES, INC. and its franchisees, associates, related companies, subsidiaries and affiliates (collectively, "Real Coast & Surf") who operate as a Real Coast & Surf resort ("Resort").

The general terms and conditions herein together with policies available on the Real Coast & Surf Website (collectively, as may be varied, amended and/or supplemented from time to time, these "Terms and Conditions") and the booking confirmation issued by Real Coast & Surf confirming your booking ("Booking Confirmation") shall constitute a legally binding contract between you and Real Coast & Surf and shall be further supplemented by the internal rules and regulations that apply specifically to the Resort where you have booked your stay.

In these Terms and Conditions, the words "we" or "us" means Real Coast & Surf and its employees, officers, agents, suppliers and vendors, and use of the words "you" or "guest(s)/Guest(s)" means any and all persons for whom a Resort room is booked. The words “Surf Camp” and “Hotel” refer to the two distinct properties of the Resort as explained in our web site. The word “room” refers to all cabanas and rooms throughout the Resort.

LOCATION:
We are located at Barangay Malapad, Reál, Quezon Province
The Surf Camp and Hotel are 180 meters apart. With beach and road access.

CORKAGE FEES

Drinks:
The corkage fee for beverages (soft drinks, beer, and liquor) is 50% of our selling price for items available in our store.

Food:
Only snacks are allowed to be brought in the Resort premises, except in the Surf Camp where guests are allowed to bring or cook their own food meals.

ROOM RATES

Room rates shown on the Real Coast & Surf Website are charged on a per room per night basis. Meals and Add-Ons are not included unless expressly stipulated.

Room rates and details are correct at the time of publication and are subject to change without notice.

NON SMOKING POLICY

Smoking is prohibited inside Resort rooms and allowed only in the smoking area(s) designated by Real Coast & Surf (if any). Failure to comply with this policy shall entitle us to terminate your booking and stay at the Resort at our sole discretion and you must leave the Resort immediately without compensation or reimbursement. You shall be liable for any costs, loss, or damage to the Resort room, premises, or property, or incurred by Resort guests or a third party, arising from your failure to comply with this policy and Real Coast & Surf reserves the right to charge you for any such costs, loss or damage incurred by Real Coast & Surf or any Resort guests or third party.

RESTRICTIONS
Reál, Quezon Travel Guidelines
1. Ages 18 and above are allowed. Must present vaccination cards.
Ages 17 and below are allowed if accompanied by a fully vaccinated adult.
2. Guests coming from MGCQ and GCQ (Alert level 1-3) are allowed.

Your temperature will be taken upon arrival and you will be required to fill out a health declaration form. In the case that one or more guests belonging to the group has a high temperature and is showing symptoms, the booking is deemed forfeited and the payment will not be refunded. So please make sure you monitor your temperature and health before traveling.

You may not bring the following into our Resort, except in our Surf Camp:
- pets (except for registered guide dogs)
- pillows, bed sheets, duvets, or other items of bedding
- any electrical appliances and/or equipment for heating and/or cooking purposes
- For the Surf Camp, only a rice cooker and a butane stove/grill are allowed.

Real Coast & Surf reserves the right to remove and/or confiscate any of the above items found in any Resort room immediately without notice to you and to charge you for any costs incurred for taking such action or for any loss or damage caused to the Resort room, premises or property or to any Resort guests or a third party as a result of your failure to comply with this policy.

Real Coast & Surf further reserves the right to ask you to leave the Resort and remove your belongings from the room immediately if we shall, in our sole opinion, deem that you have used the Resort room in an irresponsible manner or in a manner that will compromise the safety of, or cause damage and/or harm to the Resort room, the Resort premises, the other Resort guests, our staff or any other persons or the reputation of Real Coast & Surf, without any compensation and/or any reimbursement to you.

Real Coast & Surf is committed to providing a smoke-free environment in all Resort premises. Smoking is prohibited in any part of the Resort premises including but not limited to Resort rooms, except in any restricted smoking area(s) designated by Real Coast & Surf (if any) ("Non-Smoking Policy").

CHECK-IN AND CHECK-OUT

Real Coast & Surf operates a strict check-in and check-out policy.

Check-in:
Check-in is at 2:00 PM. Booked rooms will be held for check-in until 9.00 am the following day of the scheduled check-in date, after which the booking will be deemed canceled upon no-show and Real Coast & Surf shall be entitled to release the booked room(s) for the remaining stay dates to other guests. No refunds will be provided for the canceled booking.

Check-out:
Check-out is at 11:00 AM. If you check-out beyond the stipulated time, Real Coast & Surf reserves the right, without further notice to you, to charge you an additional one (1) night's stay at the then prevailing room rate or remove your belongings into the luggage storage facility (luggage storage charges may apply) and deny you further access into the room. Real Coast & Surf shall not be liable for any loss or damage to your belongings as a result of the action(s) taken.

IMPORTANT NOTICE:

- There is no WiFi at the resort. Cellular signal is also quite weak in the area. Sun and Smart signal is stronger in some spots however it is not that reliable. PisnoNet services nearby are available.
- Power outages may occur in Reál, Quezon. The local power provider sets scheduled maintenance which will result in a power outage for a few hours, rest assured you will be notified once a schedule has been set or if your booking is affected. However, some instances are unpredictable.
- As of the moment, the Surf Camp and Hotel are not wheelchair accessible.
- We only accept cash at the resort.
- Starting May 12, 2023, a Tourism User's Fee will be charged per person (7yo and above) as per (Municipal Ordinance No. 037, S-2022)

TOURISM USER'S FEE (TUF)
Regular (7yo and above): ₱40/person
SC/PWD/Student: ₱32/person

For bookings made directly through the website, the fee of ₱40/person (7yo and above) will be automatically charged. A refund/credit of ₱8 will be issued on-site upon presentation of a valid Senior/PWD/Student IDs.
For bookings made through Facebook, E-mail, or on-site, you may choose to settle the TUF upon booking or upon check-in.

*The TUF is Valid for your entire stay

DAMAGE

You are liable for any damage howsoever caused to the allocated room(s) or to the Resort premises or property caused by you or any persons in your party (whether or not staying at the Resort) during your stay. Real Coast & Surf further reserves the right to commence legal proceedings against you without notice.

RIGHT TO REFUSE ACCOMMODATION

Real Coast & Surf reserves the right to refuse accommodation to you or any person(s) without any notice and terminate any booking without being liable for any refund or compensation for the following reasons:
- the booking has been paid through fraudulent means
- the booking has been altered by anyone other than Real Coast & Surf or Real Coast & Surf' authorized agent or has been tampered with or the Booking Confirmation has been defaced (in which case Real Coast & Surf reserves the right to retain such booking documentation)
- the person checking in is not or cannot prove that he/she is the person named in the Booking Confirmation
- as permitted under the provisions of these Terms and Conditions

LIMITATION OF LIABILITY

Real Coast & Surf is responsible for providing the room(s) and Add-Ons stated in the Booking Confirmation(s) and according to these Terms and Conditions. We do not accept any liability for failure to provide the services contracted or any of them due to circumstances beyond our control.
To the extent permitted by law, Real Coast & Surf does not accept any liability arising out of any occurrences beyond its control including but not limited to acts of terrorism, acts of God, flood, war, strikes, riot, theft, delay, cancellation, civil disaster, government regulations or changes in itinerary or schedule (collectively, "Force Majeure").

Without affecting any statutory consumer rights or other laws that cannot be lawfully excluded or limited, Real Coast & Surf will not be liable for loss of any kind whatsoever arising out of, caused by, attributable to or resulting from your booking, use of the Real Coast & Surf Website or stay at the Resort even if caused or contributed to by Real Coast & Surf’s negligence, wrongful act/omission or breach of these terms and conditions or breach of duty or otherwise.

All activities have inherent risks to health and safety and Real Coast & Surf will not be responsible for any eventualities related to any activities or services booked through the Real Coast & Surf Website or during your stay at the Resort.

Real Coast & Surf will not be responsible for any loss or damage of property left in the Guest's room and/or the Resort property at all times. Guests are advised to obtain insurance to cover curtailment, and loss of luggage, personal effects, damages, personal injury, and money/valuable belongings.

PRIVACY & DATA PROTECTION

Real Coast & Surf will retain all personal information you provide during booking. By making a booking with us or using the Real Coast & Surf Website, you consent to our use and/or disclosure of your personal details to our franchisees, branches, related corporations, associates, subsidiaries, affiliates, assignees, proposed assignees, agents, commercial partners, service providers and/or any other parties engaged by us to enable or assist us in the provision of services or to exercise or enforce our rights hereunder and/or any other party as Real Coast & Surf may, in our sole and absolute discretion, deem necessary for the following purposes:
- to process your booking and for other administrative purposes
- to provide you customer support and services
- to send you information on products and services, and special or promotional offers, newsletters or customer survey forms and questionnaires. You may unsubscribe from these at any time by clicking on the “unsubscribe link” on the relevant email communications.

We may also be legally obliged to disclose, and you irrevocably consent to our disclosing, your personal information to government and enforcement agencies, regulatory bodies, and public authorities or as may be required by law. This may involve sending your personal information between different countries.

We will use our best endeavors to use your personal information in the manner stated herein and will not otherwise disclose your personal information without your prior written consent.

COOKIES

Real Coast & Surf uses cookies in our webpages to:
- maintain your session and required details when you browse the Real Coast & Surf Website, during account registration and during the booking process (session cookie)
- collect website usage data for statistical/analytics purposes (analytics cookie)
- direct you to the correct landing page based on your geo-location (geo-targeting cookie)
- You may instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites that you visit. Real Coast & Surf Website will not function properly if cookie setting is disabled.

COPYRIGHT & TRADEMARKS

The Real Coast & Surf Website including the booking and other applications, text, graphics, designs, audio and video clips, Resort and destination information and all other content thereon are the property of Real Coast & Surf and/or its content suppliers.

You may use the Real Coast & Surf Website and its content solely for personal, non-commercial and private use subject always to applicable copyright laws.

All trademarks, trade names, service marks, and all other marks, whether registered or unregistered, on the Real Coast & Surf Website are owned by or licensed to Real Coast & Surf and their respective owners and may not be used, reproduced or modified without the prior written approval of Real Coast & Surf.

DISCLAIMER

The Real Coast & Surf Website, the services provided and all content thereon are supplied "as is" and "as available". Real Coast & Surf provides no guarantee regarding the website and content. You are solely responsible for your use thereof.

While we will make every effort to ensure that the information on the Real Coast & Surf Website is accurate and published in good faith. Without affecting any statutory consumer rights that cannot be lawfully excluded or limited, Real Coast & Surf does not warrant or represent the accuracy of the information displayed and disclaims to the maximum extent permitted by law all warranties expressed or implied by statute, custom or usage.
Real Coast & Surf will not be liable for any direct, indirect, consequential, punitive losses or damage (including without limitation loss of revenue, loss of goodwill, loss of reputation and loss of, or damage to data), arising out of the Real Coast & Surf Website or the use thereof or any services purchased from the Real Coast & Surf Website, or any errors, inaccuracies or omissions in the services or content provided howsoever caused.
The various linked sites on the Real Coast & Surf Website allows for further link-up and interaction between Guests and the said sites for promotions and other interactive mediums. The inclusion of all website links on our Real Coast & Surf Website does not imply endorsement by Real Coast & Surf of such linked sites, or any association with their operations. These sites are outside the control of Real Coast & Surf. We will not be responsible for the content on the linked sites or your use thereof.

GOVERNING LAWS

Your contract with Real Coast & Surf is governed by the laws of the Philippines any disputes shall be settled in the courts of the Philippines.

CHANGES TO THE THESE TERMS & CONDITIONS

Real Coast & Surf reserves the right to cancel, amend or vary the arrangements and content featured on the Real Coast & Surf Website and/or change, amend, vary or add to these Terms and Conditions at any time without prior notice. You will be notified of any changes to these Terms and Conditions as made available on the Real Coast & Surf Website. Please check the Real Coast & Surf Website regularly for updates to these Terms and Conditions.

CONFLICT BETWEEN ENGLISH TEXT AND OTHER LANGUAGE TEXT

If there is any conflict or discrepancy between the English text of these Terms and Conditions and any translation thereof into any other language, the English text shall prevail.

Políticas de pago

Bookings may be made online at www.realcoastandsurf.com ("Real Coast & Surf Website"), Facebook, or at our Resort.

Full payment must be made at the time of booking. We accept payment by Visa or Mastercard credit/debit cards, Paypal, and major credit card providers supported by Paypal. The available payment options are displayed during the booking process on our Real Coast & Surf Website. A VAT of 12% will apply to all bookings.

Once your booking has been successfully completed, a Booking Confirmation will be issued in respect of each room booked and sent to the email address that you have provided. You MUST produce your Booking Confirmation(s) upon check-in at the Resort, together with your original valid photo identification document (national registration identity card, passport, driver's license, or other identification card or document as the Resort may require). If you do not receive your Booking Confirmation(s) within twenty-four (24) hours from the time of booking, please contact us via the Real Coast & Surf Website.

The 'Guest' named in the Booking Confirmation must be the person staying at the Resort otherwise we reserve the right to cancel the booking.
At all times during the booking process, you will be advised to ensure the accuracy of your booking details (guest details, stay dates, room types, room rates, number of guest(s), Add-Ons). Real Coast & Surf will not be responsible or liable for errors in booking details.

If the card owner is not the one staying at the Surf Camp/Hotel, the guest is required to present a letter of authorization signed by the card owner and their valid government-issued photo ID. Reál Coast & Surf reserves the right to refuse the guest to check-in for failure to comply with these requirements or may cancel a confirmed reservation if a booking is suspected to be made using a fraudulent credit card.

Bookings are accepted subject to room availability.

Política de cancelación

CHANGES AND CANCELLATIONS

FORCE MAJEURE
The resort shall not be held liable for failure to comply with this Agreement due to force majeure, labor disputes, natural disasters or other causes beyond the control of the management.

Changes:
Changes on your booking is allowed if made four (4) days or more before check-in date. This must be requested via e-mail or Facebook and acknowledged by Real Coast & Surf. Date change must be on the same month or the month after. Maximum of 2 changes per booking only.

NO CANCELLATIONS allowed for Weekend Bookings (Friday, Saturday and Sunday) and Super Peak Season/Holidays. (Initial date of booking will be considered)

Cancellation fees will be charged depending on the number of days prior to your booked date. All cancellations must be made via e-mail or Facebook messenger in order for us to accurately honor the cancellation date based on the time stamp. Fees are as follows (in days prior to booked date):

– 7 days or more:

HOTEL

Paypal/Credit Card Payments: Php 500 per room per night or 5% of room rate (whichever is higher)
Bank Deposit: Fee of Php 500 per room per night for BPI online transfer or Php 600 per room per night for deposit to other banks/provincial bank branches

SURF CAMP

Fee of Php 250 per cabana per night or 5% of cabana rate (whichever is higher) for BPI online transfer and Paypal/Credit Card Payments or Php 350 per cabana per night for deposit to other banks/provincial bank branches

– 3-6 days: 50% refund

– 1-2 days: NO refund

Unless otherwise expressly stated, no changes or cancellation will be allowed for promotional bookings. Please read the terms and conditions of the relevant promotion carefully, which terms of promotion shall apply to the booking and shall be binding on you.

NO SHOW on the same day as the check-in date will incur a penalty fee equivalent to ONE HUNDRED PERCENT (100%) of the total package amount and any down payment made is deemed non-refundable.

Valid refunds will be processed within 30 to 60 working days after approval.
