Terms & Conditions

Dhelkaya Health hereby agrees to rent to the Tenant, named at booking, the property located in the City of Castlemaine, State of Victoria, at Cornish Street/ Odgers Road commencing from the date of this booking until this booking is terminated.
1. Rent
Tenant agrees to pay Dhelkaya Health the sum of $25 per night or $125 per 7 nights. (All prices are inclusive of GST). Rooms are available from 2pm on day of arrival and must be vacated with key returned to the Education Centre by 10am of day of departure, unless alternative arrangements have been made.
Rental charges may increase subject to annual review.
2. Payment of Rent
Rent must be paid for prior to arrival & can be paid in full/fortnightly, or for Dhelkaya Health staff via payroll deduction. If the Tenant wishes to alter payment arrangement, this request must be made to Education Administration prior to arrival.
3. Arrival & Key Collection
Tenants will be provided with a map of the hospital grounds and accommodation site prior to arrival. During business hours, accommodation keys can be collected from Education Administration, all other times the keys will be left with main reception or After Hours Manager.
4. Use
The Tenant agrees to use the premises only as a residence. No animals, illegal drugs, parties or other social functions are permitted on the premises at any time. The Tenant agrees to assume all responsibility for actions taken by any person entering the property. Dhelkaya Health will hold the Tenant solely responsible for all damages to the property or for any violations against this Rental Agreement & Accommodation Rules.
Dhelkaya Health is a smoke free campus. Smoking inside any hospital building will result in immediate eviction.

5. No Personal Visitors Allowed.
Accommodation is designed for short term accommodation only, for students completing placements and staff as required. For the comfort and privacy of all tenants, no visitors are permitted in accommodation. Castlemaine has many accommodation options should you wish to stay with family and friends.

6. Cleaning
The Tenant hereby agrees to accept the property in its present state of cleanliness. The Tenant agrees to return the property to the same condition or better.
Cleaning of the accommodation, including common areas, is to be maintained by tenants. This includes tenants washing their own dishes, cleaning stove top & microwave after each use, fridge, wiping up spills as they occur, cleaning & removal of general food mess from the floor, refrigerator and removal of rubbish/recycling to the external rubbish bins. Failure to do so incurs an additional cleaning fee & tenants will be required to vacate accommodation.
Dhelkaya Health Environmental Services team will complete minimal cleaning i.e. vacuum, sweep or mop common areas; kitchen, bathroom and lounge weekly.
If rooms & communal areas are not kept in a neat, clean & tidy state, tenants will be charged, an additional cleaning fee & required to vacate accommodation.
NOTE: Linen is not provided, unless prior arrangements have been made & an additional fee of $30 is charged for linen provided.

7. Condition of Premises / Repair Policy
The Tenant acknowledges that the rental property is in good condition. If there is anything about the condition of the property, that is not satisfactory, this must be reported to Education Administration on 5471 3223 or Ext 13223.
Any damage and maintenance requirements inclusive of general issues must be reported to Education Administration
5471 3223 or Ext 13223, Monday-Friday between 8am-4:30pm, any urgent issues only outside of these hours, please contact the Nursing Supervisor on 5471 3499 or Ext 13499.
Tenants will be invoiced/payroll deduction, if required for lost keys, damage/repair to the property or any additional cleaning.
Lost keys must be reported to Education Administration 5471 3223 or Ext 13223 within 24 hours.
8. Noise
Tenants must consider others, with the use of radios, mobile phones, washing machine, clothes dryer etc. All devices which may disturb another tenant, must not be used before 7am and after 10pm. Acknowledge the rights of other tenants, who may be shift workers. Any disturbances will be reported to the Police.
9. Parking
All parking at Dhelkaya Health is free. Please obey the parking signs. The gravel carpark opposite the main entrance is the most appropriate.
9. Acceptable Internet Use
Wireless network is available in the accommodation & the wifi code is listed on the noticeboard in the main passage, opposite the dining area. This rental agreement sets out strict guidelines for acceptable use of the internet by tenants of Dhelkaya Health. The primary purpose, the internet is provided by Dhelkaya Health, is to assist tenants to carry out their studies/work. The internet may be used, for reasonable private purposes, which are consistent with the acceptable use guidelines listed below.
What is acceptable use:
Subject to the balance of this policy, tenants may use the Internet access provided by Dhelkaya Health for:
• Study-related purposes;
• Sending and receiving personal email messages, provided that if email messages are sent with a Dhelkaya Health email address in the From: or Reply-To: header, a disclaimer shall accompany the email to the effect that the views of the sender may not represent those of Dhelkaya Health;

• Reading and posting personal Usenet messages on the same condition specified above;
• Using instant messaging software for personal purposes;
• Utilizing any other Internet service or protocol for personal purposes after obtaining permission to do so from Dhelkaya Health; provided in each case that the personal use is moderate in time, does not incur significant cost for Dhelkaya Health and does not interfere with the duties of a student or his or her colleagues.
What is not acceptable use:
Except in the course of a student’s duties or with the express permission of Dhelkaya Health, the Internet access
provided by the Health Service must not be used for:
• personal commercial purposes;
• sending unsolicited bulk email;
• disseminating confidential information of Dhelkaya Health;
• any illegal purpose;
• knowingly causing interference with or disruption to any network, information service, equipment or any user thereof;
• disseminating personal contact information of employees or students of Dhelkaya Health without their consent;
• knowingly causing any other person to view content which could render the company liable pursuant to equal opportunity or sex discrimination legislation at the suit of that person; or
• Knowingly downloading or requesting software or media files or data streams that the student has reason to believe will be illegal or inconsistent with their governance responsibilities, or be costly to the organisation.
• Use of Peer to Peer downloading services including torrent sites, accessing streaming media sites, excessive downloading of non-study related material.
Consequences of unacceptable internet use
Dhelkaya Health keeps and may monitor logs of Internet usage which may reveal information such as which Internet servers have been accessed by students, and the email addresses of those with whom they have communicated. Dhelkaya Health will not, however, engage in real-time surveillance of internet usage, will not monitor the content of email messages sent or received by its students unless a copy of such message is sent or forwarded to the company by its recipient or sender in the ordinary way, and will not disclose any of the logged, or otherwise collected, information to a third party except under compulsion of law.
Responsibility for use of the internet that does not comply with this policy lies with the student so using it, and such the student must indemnify Dhelkaya Health for any direct loss and reasonably foreseeable consequential losses suffered by the company by reason of the breach of policy.
Dhelkaya Health will review any alleged breach of this agreement on an individual basis. If the alleged breach is of a very serious nature which breaches the students duty of fidelity to the company (for example, emailing confidential information of the company to a competitor), the student shall be given an opportunity to be heard in relation to the alleged breach and if it is admitted or clearly established to the satisfaction of the organisation the breach may be treated as grounds for dismissal from further study at Dhelkaya Health.
Otherwise, an alleged breach shall be dealt with as follows:
• Initially, the student shall be informed of the alleged breach, given an opportunity to respond to the allegation, and if it is not satisfactorily explained, be asked to desist from or where applicable to remedy the breach.
• If the breach is not desisted from or remedied, Dhelkaya Health may either withdraw the student’s access to
the Internet or provide a first warning to the student, to which they shall have an opportunity to respond.
• If the infringing conduct continues the student may be given a second and a third warning, to each of which he or she shall have an opportunity to respond.
• If a breach is committed after the third warning the student may be dismissed with approval by the Chief Executive Officer.

Internet access provided by Dhelkaya Health must not be used, in such a way, as to significantly interfere with the duties of their study or to expose Dhelkaya Health to significant cost or risk of liability. Dhelkaya Health may modify this policy/form upon 30 days notice in writing to students.
10. Non-assignment of Rental Agreement
The Tenant agrees not to assign this agreement. This agreement is to provide residence to the Tenant only and therefore cannot be transferred to another party. Guests are not permitted on the premises.
11. Cancellations
Please contact Education Administration, at least 48 hours prior to arrival date to cancel bookings. For any bookings longer than a week you will be required to contact Education Administration at least 1 week prior to arrival date. Failure to do this, you will be charged one nights rent for any bookings less than a week and 1 weeks rent for any cancellations of bookings longer than 1 week.
12. Departure
Keys must be returned to Education Administration by 10am on the date of departure or if vacating after hours, alternative arrangements must be made with the Education Administration prior to departure. Tenants not returning accommodation keys on departure, will be charged for each night, until the keys are returned.
Tenants are required to pay an additional fee of $150 for lost key/s, this includes keys not returned to Education Administration & misplaced within another Dhelkaya Health Department.
If the tenant has paid a bond, this will be refunded via cheque within one month of departure, once all payments have been received by our Finance Department and the Environmental Services Department will report to the Education Administration, that the rental accommodation was vacated in a satisfactory condition.

13. Full Disclosure
By signing this Rental Agreement the tenant hereby states that they fully understand all the provisions of the agreement and the obligations and responsibilities of each party, and understand that Failure to abide by any of these rules may result in immediate eviction.
