THE FIGS is an idyllic private garden and rural oasis in the heart of the beautiful Byron Shire featuring panoramic views from the Border Ranges National Park, to the iconic Mount Warning and Mount Chincogan, all the way to the Pacific Ocean at Brunswick Heads. Our newly built award-nominated accommodation suites are nestled within 10 acres of expansive and stunning subtropical gardens, orchards and paddocks, highlighted by 4 magnificent 250 – 300 year old fig trees and a myriad of rare and exotic palms and flowering trees and shrubs, the perfect weekend escape or wedding venue. We have more than 500 metres of pathways through the gardens, much of it wheelchair accessible, as well as more than 60 different varieties of organic fruits and nut trees in the surrounding gardens and orchards, producing wonderful succulent fruit for most of the year. Our resident flock of Wiltshire Horned Sheep provide a finishing touch to this beautiful and unique rural setting. THE FIGS is ideally located in the centre of the tourist mecca of Byron Shire, just off the M1 Motorway, only 5 minutes to Brunswick Heads and its beautiful river and beaches, only 15 minutes to the centre and buzz of the iconic Byron Bay, and only 5 minutes to the charm of Mullumbimby, and the gateway to the rainforests and attractions of the Byron Hinterland.

THE FIGS BYRON - Hosted Holiday Accommodation

TERMS AND CONDITIONS

1) DEFINITIONS
a) “Booking” means the period for which you have paid to stay at the Property.
b) “Hosted Accommodation” means that the owners live on site. In general, there will be someone present on site, or nearby, at all times. “The Figs Byron” is our home. We think it is a special place and are happy to share our special place with guests who show us the appropriate level of respect in return.
c) “Property” means the specific apartment or house and all associated fixtures, fittings and equipment that you have paid to use during your stay at the Property and those areas designated as publicly accessible at “The Figs Byron”, located at 66 Hyrama Crescent, Brunswick Heads, NSW.
d) “Management” means the owners of the Property or their nominated representatives.
e) "Guests" means only those persons who are authorised to stay overnight in the Property during the Booking.
f) "Visitor" means a person a Guest temporarily permits to visit the Property during the Booking and does not include overnight stay. As a basic courtesy, and for security reasons, we require that you advise us of your intention to have visitors come to the Property during your stay, prior to any action.
g) “Festival Bookings” refer to any bookings for Falls Festival, Bluesfest or Splendour in the Grass festivals. The dates for these festivals vary from year to year.

2) ACCEPTANCE OF TERMS AND CONDITIONS
Payment of the Booking, or a minimum of a 50% deposit, constitutes acceptance of these Terms and Conditions.

3) CHECK-IN/ OUT
a) Normal Check-In time is between 3pm and 6pm on the arrival date unless other arrangements have been agreed prior to arrival.
b) Please notify The Figs Byron of your expected arrival time and a mobile contact number at least 2 days before arrival. This will greatly assist us to ensure your registration and Check-In is smooth and efficient.
c) Upon arrival, guests must come to the Reception located at the main house, to obtain a key /card for their accommodation and to undertake routine registration.
d) Check-Out time is no later than 10am on the departure date, unless approved by prior arrangement. Late departure may be subject to extra charges, which will be confirmed prior to approval.
e) Upon Check-Out, all keys/ cards must be returned to the Reception prior to departure or an additional $50 fee will be charged to the guest‘s credit card.
f) It would also be much appreciated if guests can provide feedback to the owners about their experience during their stay. We greatly value feedback, be it positive or negative.

4) BOOKING, PAYMENT CANCELLATION AND REFUND POLICY
a) A minimum 50% deposit is required at the time of booking to secure all reservations. THIS IS A NON-REFUNDABLE PAYMENT. Payment for the full amount may also be paid at this time and is the preferred method of payment. The remainder of the booking fee must be paid no later than 7 days prior to the booking date. This is usually undertaken automatically using the credit card details provided during the booking process.
b) Payment is required in Australian dollars (AUD) and net of any other banking fees or other administration or transaction charges.
c) We accept payment by the following methods:
i) Visa, MasterCard, American Express. A surcharge will be charged for using credit cards, consistent with the costs charged to us by the banks.
ii) Direct deposit into our bank account. - If you wish to pay by this method, we will notify you of our bank details by email.
iii) Personal cheques - Cheques will only be accepted if received at least 30 days prior to arrival and cleared prior to acceptance of the Booking. A surcharge of 5% will be charged for handling costs for personal cheques.
iv) Cash payments.
d) Bookings can be cancelled or amended up until 7-days prior to your arrival date, with the exception of “Festival Bookings”, which can only be cancelled or amended up until 30 days prior to your arrival date. At that time the full accommodation charge for the full reservation will be due and payable, or the Booking will be cancelled. If the full amount of the Booking had been paid prior to these designated times, and a cancellation has been requested within the approved periods, a full 50% refund for the non-deposit component of the payment will be made.
e) If you need to cancel the Booking within the designated periods mentioned in d) above, refunds will only be considered if The Figs Byron are able to rebook the room. If rebooking is successful, either full or partial rebooking, a refund will be made for the total payment received for the rebooking less a $50 administration fee.
f) There will be no refund for early departures.
g) A variation of the Booking which reduces the number of nights stay will be a treated as a cancellation of the Booking in respect of those nights.
h) A variation of the Booking which reduces the number of guests will be treated as a cancellation of the Booking in respect of those guests.
i) An administration charge of $50 will be charged for any reduction or cancellation in the original booking. No fee will be charged for extending the booking. Of course, extensions of the booking will be subject to availability.
j) We have a “minimum nights stay” policy of 2 nights. No refund will be made for a Booking variation to the extent that it breaches this policy.
k) In the event of any Bookings being cancelled by the owner, for any reason, a full refund will apply.
l) In the event of any cancellation request made due to verifiable Covid 19 restrictions, which specifically restrict your ability to utilize your booking due to lockdown requirements, all amounts paid will be held in an open-ended credit for you to apply at any time in the future, subject to availability at that later time. To request this, please call The Figs Byron as soon as possible to discuss the options.

5) SECURITY BOND
Unfortunately not all guests display the same level of respect for our Property as we would like. As such, we are obligated to request some form of Security Bond process be in place prior to issuing keys for the accommodation. In general, this will be an automatic process that takes place when you make the initial Booking. In providing your credit card details, you are accepting our right to charge you for various additional charges or costs for damages on your nominated credit card for up to $1800 in the event of any breach of these Terms and Conditions and/or payment of costs for significant damage to the accommodation provided during your Booking or to other areas of the Property which can be attributed to your behaviour or that of your visitors (either approved or not). If, for any reason, the Guest does not wish to use this credit card approach to a security bond, other options may be available, including providing a cash security deposit, or a direct deposit, either of which must be paid prior to, or upon arrival. Any actual payment of the security bond that necessitates a refund will be credited to your designated payment method as soon as our property has been inspected and deemed to have been left in a similar state to your arrival. We agree to ensure this occurs promptly, and certainly within 7 working days of your departure. If for any reason your credit card does not enable us to make these additional charges, we have the right to pursue the damages through a legal process.
Any damage, loss or expense incurred by The Figs Byron as a result of any breach of these Terms & Conditions will be charged against the bond or your credit card. Examples of this include, but are not limited to, any breakage, damage or excess cleaning requirements, staining of linen or towels, extra guests beyond those declared, impact of smoking in the rooms, etc., or as specified elsewhere in these Terms and Conditions.

6) UNAVAILABILITY
If the Property becomes unavailable for your Booking period due to unforeseen circumstances (e.g. fire, storm, damage, etc.) then Management will inform you as soon as possible and endeavour to obtain suitable alternative accommodation for your occupancy. In this event, any moneys paid will be refunded in full.

7) PARTIES & FUNCTIONS
a) Parties, other than approved formal Weddings and Events, are strictly prohibited without formal written approval from the Management.
b) Weddings and Event functions require prior approval at the time of Booking and special conditions will apply.
c) Any breach of these rules will result in extra charges being incurred and may result in immediate termination of your Booking, with no refunds.

8) CHILDREN
The Figs Byron is designed specifically for adult guests. We are sorry we are unable to accommodate infants or children under 12 years of age. (This policy may be varied for Weddings and other approved Events.)

9) LINEN AND TOWELS
a) We supply linen, pillows, quilts, bathrobes and towels, which must not be removed from the rooms or Property at any time, particularly for use at the beach.
b) Any serious damage, excessive staining or loss of linen, pillows, quilts, bathrobes or towels will incur additional charges, as appropriate to the items concerned. These charges will reflect additional costs for laundering, and/or replacement of the items, as appropriate to the situation. Separate charges will be made against your bond or credit card for all items under this category.
c) Please note that this property has red volcanic soil that can easily leave stains on linen items, so please be careful to avoid this problem. We would ask that you leave shoes outside your room wherever possible. Also, linen and towels can easily be permanently stained by some tanning lotions and makeup products, so please avoid these when using our linen and towels. Thank you.

10) SMOKING
a) The Figs Byron has a strict “No Smoking” policy within 5 metres of any of the buildings on the Property, with the exception of the gazebo. Only the gazebo is acceptable as a smoking area, except during events where an alternate location is identified.
b) A minimum charge of $500 will be levied for any smoking inside accommodation buildings to cover 2 days room charge and all associated cleaning and deodorising costs. Breaches of this rule may also result in cancellation of the Booking, with no provision for a refund.
c) Many guests have health reasons for avoiding smoking by others and our strict policy reflects our respect for their request.
d) Under no circumstances are cigarette butts to be left anywhere in the gardens or grounds of the Property.

11) PETS
We do not allow pets at The Figs Byron. Our Property has other farm animals and lots of wild birds and other fauna and we cannot have other animals on the property. We are sorry that we have to enforce this rule as we know your pets are important to you. (This policy may be varied in certain circumstances associated with Weddings and other approved Events).

12) GUEST RESPONSIBILITIES
a) Guests must comply with all applicable rules and all instructions from Management concerning occupancy, property, health, safety and quiet enjoyment of the Property and our neighbours.
b) Guests are responsible for any damage, breakages, theft and loss of items in their designated accommodation, or to the Property where it can be reasonably determined that the guests were directly at fault, during their stay. Guests are obligated to notify Management of any problems of this nature immediately. Charges may be raised wherever it is deemed that the damage, breakages or theft are the Guest’s responsibility. The costs of repair or replacement will be assessed and charged based on fair market value, which will be determined at the owner's discretion.
c) Guests remain responsible for the behaviour of all unapproved persons or approved visitors attending their accommodation or the Property on their behalf.
d) No disturbance of neighbours (be it in adjoining accommodation or adjoining properties) and no excessive noise will be tolerated. Unreasonable disturbance to our neighbours may result in termination and eviction without refund and extra charges may be made for security and other expenses.
e) It would be appreciated if you could limit noise when entering and leaving your accommodation, and any behaviour likely to cause damage to property or offence or embarrassment to others, will not be tolerated. Please remember that The Figs Byron is our home and we also live on the Property and want all our Guests to have the same level of respect for us as we will have for you. All significant noise must cease by 10pm, consistent with rules from the Byron Shire Council.
f) Excessive consumption of alcohol or drugs while on the Property will also not be tolerated. Any breach of this condition may result in immediate termination of the Booking and eviction without refund and extra charges will be applied for all reasonable costs associated with the breach of these conditions, including use of security, cleaning, and any financial impact as a result of the response by neighbours to your actions.
g) Any breach of the Terms and Conditions that necessitate calling of security or police will immediately incur a fee of $500 in addition to any other charges listed under these provisions.
h) Only the Guests nominated and agreed in the Booking may stay in the Property overnight. If any other guests stay, extra charges will apply or the agreement may be terminated without refund.
i) Before departure, the Property must be left in a reasonably clean and tidy condition, consistent with basic use of the facilities and the state of the accommodation upon arrival. Extra cleaning charges will be incurred for excessively messy or dirty conditions upon departure, up to $300.
j) Furniture is not to be moved around. Items are not to be moved from room to room. All furniture and furnishings must be left in the position they were in when the Guest arrived.
k) The Property should be vacated on time and secured. All doors are to be locked and all keys/cards must be returned to the Reception prior to departure or a $50 charge per key/card will be added to your credit card.
l) The Figs Byron is also a hobby farm and frequently has farm vehicles and tractors on the road. Priority of “right of way” exists for all farm vehicles on the Property.
m) All Guests are responsible for keeping their allocated accommodation secure during their stay and will be responsible for any theft or damage due to neglect in this area.
n) Any areas designated as private by the owners are strictly out of bounds.
o) Any description of the Property and its inclusions is as accurate as possible at the time of writing. Without prior inspection, no guarantee can be given that a property will satisfy the Guest’s expectations.
p) Departing guests must leave their accommodation clean, tidy and secure. This includes at least placing all dirty dishes and cutlery in the dishwasher, placing all rubbish in the appropriate bins, including separation of recycling and compost, emptying of the refrigerator, cleaning of the stove & microwave, turning off the lights & all appliances, including air conditioning. Guests are required to secure the premises upon departure by locking the doors and windows.

13) NATURAL ENVIRONMENTALLY SUSTAINABLE SETTING
a) The Figs Byron is a beautiful natural setting with extensive gardens and trees, including magnificent old fig trees that are estimated to be at least 300-350 years old, and animals (both farm and native). Given this natural and farm setting, it must be understood that the owners cannot totally control everything that happens on the Property. All guests and their visitors must understand that there may be insects, animals and plants that can cause harm to people if they are not respected. So please DO NOT go into the paddocks where the sheep are, as the ram may not understand your actions, no matter how well intentioned you may be. Also there are some plants with very sharp spines and some insects that bite, some trees that drop branches, particularly in a high wind, and finally there may be the occasional native animal or snake that may be wandering past that will not appreciate any undue attention. The Figs Byron owners want you to enjoy all the beauty and nature that will surround you at the Property, so please understand and respect the farm and natural setting that is available. By confirming your Booking to come to The Figs Byron, you are accepting all the risks that accompany the farm and natural setting.
b) The owners of The Figs Byron believe in the need to be environmentally sensitive and have embraced these values throughout the development of the Property. Part of these values is our commitment to recycling our rubbish. We expect Guests to do their best to also follow the Local Council requirements for recycling their rubbish while at The Figs Byron. Suitable containers for compost, recycling and ordinary rubbish are provided to facilitate this. If you are in doubt about the requirements, there is an instruction sheet in your accommodation that explains this in more detail, or just ask us.
c) The owners would ask you to ensure that when you leave your accommodation for any extended period that you turn off the air conditioner, should you be using it, until you return. Wasteful energy consumption is not an acceptable environmentally sustainable practice.

14) PROBLEMS OR COMPLAINTS
a) In the case of any problem or complaint, please just let us know promptly and we will be very happy to assist, wherever possible, to rectify the situation as quickly and efficiently as possible.
b) If remedial work is required, we have to ask you to allow any repair/service access to the Property during reasonable hours to rectify the problems. We will work closely with you to limit any inconvenience to you.

15) WEBSITE DISCLAIMER
a) Whilst every effort is made to keep our website up-to-date and accurate, The Figs Byron reserves the right to change the information contained on the site whenever necessary and makes no guarantee as to the accuracy of the contained information at a given point in time.
b) The information provided by The Figs Byron on our website, which may include, but is not limited to, general information, advertising, suggested action and advice, products and services, is owned by The Figs Byron and is subject to copyright.
c) The information compiled by The Figs Byron is of a general nature and should be used for reference only. 16) INDEMNIFICATION AND LEGAL LIABILITY
a) To the full extent permitted by law neither the owners nor its agents shall be liable for any loss injury or damage (including loss of personal property) sustained by the Guest or his/her visitors or guests (either approved or unapproved) in the course of the Booking period and the Guests and his/her visitors or guests hereby release, discharge and/or indemnify the owner or its agents in respect of any such loss, injury or damage.
b) This includes damage from other vehicles whilst you are on the Property.
c) No responsibility is taken for guest’s property left on or near the Property.
d) It is recommended that the Guest take out travel insurance to provide protection against loss due to illness, injury, death, damage, loss or cancellation of tenancy.

17) VARIATIONS TO TERMS AND CONDITIONS
Variations to these Terms and Conditions may only be made by prior arrangements with the owners, or their representatives, in writing.
